1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the TipFolio mobile application, website at tipfolio.app, and related services (collectively, the "Service") operated by TipFolio ("we," "our," or "us").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or guardian.

3. What TipFolio Does (and Does Not Do)

3.1. Service description

TipFolio provides tools to:

  • Log cash and card tips by shift
  • View weekly and monthly totals
  • Generate IRS Form 4070A-style records and related export documents (Pro features)
  • Export backups and share files you create

3.2. Not tax, legal, or financial advice

TipFolio is not a tax preparation service, accountant, lawyer, or financial advisor. We do not file taxes, report tips to the IRS or your employer, or guarantee that any export meets legal or employer requirements.

You are solely responsible for accurate tip reporting, submitting forms to your employer by required deadlines (see IRS Publication 531), and consulting qualified professionals for tax, legal, or lending decisions.

4. Accounts and Local Data

The current version of TipFolio does not require an online account. Your tip logs are stored on your device unless you export them. You are responsible for accuracy, backups, and securing your device.

5. Subscriptions and Payments

Some features require a paid TipFolio Pro subscription. Purchases are processed by Apple or Google, not directly by us. Manage or cancel subscriptions in your device account settings. Refunds follow applicable app store policies.

6. Acceptable Use

You agree not to use the Service unlawfully, interfere with the Service, or misrepresent generated documents as filed with any government agency.

7. Intellectual Property

The Service is owned by us or our licensors. You receive a limited license for personal use. You retain ownership of data you enter.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant uninterrupted operation, accuracy for your situation, or specific financial outcomes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS ($50).

10. Indemnification

You agree to defend and indemnify us against claims arising from your use of the Service or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

11. Tax Disclaimer

TipFolio helps you organize and export tip records. It does not:

  • File IRS Form 4070, 4070A, or any tax return on your behalf
  • Replace employer payroll or tip reporting systems
  • Guarantee compliance with federal, state, or local tax law

Always confirm requirements with your employer and a qualified tax professional.

12. Third-Party Services

The Service integrates with Apple App Store, Google Play, and RevenueCat. Your use of those services is subject to their terms and privacy policies.

13. Changes

We may modify the Service or these Terms. Updated Terms are posted at tipfolio.app/terms.

14. Termination

You may stop using the Service at any time. We may suspend access for breach of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
